Hyperchecks ("application") is a software used to record electronic patient observations via a mobile device. 

At Hyperchecks, LLC ("we," "us," or "our") we are committed to protecting your privacy and ensuring the security of your personal health information. This Privacy Policy explains how we collect, use, and safeguard your data when you use our healthcare application and related services. If you do not agree with our policies and practices, please do not use our service. 

We collect the following types of information to provide you with the best experience:

• Personal Health Information (PHI): When you use our application, we may collect sensitive health-related data, such as patient initials, medical record number, observation data, and other health information that you provide. We will keep this sensitive health-related data private. We will not release patient initials or medical record numbers to any third parties or any public or private entities. We will not attempt to link the data back to the user’s identity. Additionally, we will not tie the data to other datasets that enable it to be linked to the user’s identity. We may release observation data, including behavior and location and compliance data that is stripped of any patient identifiers, for research purposes.
   
• User Information: This includes your initials while signing off observations.  We will not release this information. We will keep this sensitive user-related data private. We will not release user data to any third parties or any other public or private entities. We will not attempt to link the user data back to the user’s identity. Additionally, we will not tie the data to other datasets that enable it to be linked to the user’s identity.
   
• Usage Data: We may automatically collect data about how you use the app, including device information, IP address, usage patterns, and app interactions.
   
• Cookies and Tracking Technologies: We may use cookies to personalize your experience on our app and gather analytics data to improve our services.
   

We use the collected information for the following purposes:

• For Research Purposes: We use your information to track compliance rates and timeliness when using the application for research purposes. 

• To Provide Health Services: We use your health information to offer recommendations, and support.
   
• To Improve Our Services: We may analyze usage data to enhance the application's functionality and user experience.
   
• To Communicate with You: We may use your contact information to send updates, reminders, and notifications related to your health data or our services.
   
• For Legal and Compliance Purposes: To comply with healthcare regulations (e.g., HIPAA in the U.S.) and to protect your safety and well-being.

The application is compliant with The Security Rule, a provision of HIPAA, which outlines policies and procedures required to protect electronic patient health information. The application has administrative, physical, and technical safeguards that help prevent the unlawful disclosure or destruction of patient health information. However, no system is completely secure, and we cannot guarantee absolute security.

We encourage you to take steps to protect your account, such as using a strong password and automatic log offs.

• Access and Correct Your Information: You can review, update, or request a copy of your health information in our system.
   
• Delete Your Data: You may request the deletion of your personal data, subject to applicable laws and retention requirements.
   
• Opt-Out: You can opt out of receiving marketing communications or notifications from us.
